Purpose for processing Biometric Data:
You have been directed to this Facial Scan Biometric Policy by a company or entity that owns or operates a website, application or platform, from which you are trying to use or access certain services or offerings (the “Client”). HyperVerge is a service provider to the Client and helps the Client to verify its users’ identities so the users can access the Client’s services in a secure and seamless manner (“Permitted Business Purpose”). At the Client’s requirement of accomplishing the Permitted Business Purpose, HyperVerge, and its service provider named below, will collect, capture, obtain, possess, store, use, process, disclose and re-disclose (“Processes”) Biometric Data on the Client’s behalf, for the purposes of:- Identity Verification: Verifying your identity by comparing facial Biometric Data extracted from the photo/video of your face, to facial Biometric Data extracted from the photo in your identity document. HyperVerge generates two scans of your face: (i) one from the image provided by you (such as a selfie), and (ii) one from the reference image (such as in your identity document), and compare those two scans to assess whether the person in the image is likely to be the same person pictured in the reference image;
- Authentication: Authenticating you and your use of the Client’s services by comparing facial Biometric Data from a reference image (for example, an image you provided to the Client when you signed up for an account or the photo in your identity document), to the facial Biometric Data extracted from a new photo/video of your face;
- Deepfake Detection: Analysing Biometric Data to detect and prevent deepfakes or artificial intelligence generated/engineered images;
- Authenticity Analysis: Evaluating the authenticity of images and videos and identity documents, including detecting whether there is a genuine human or physical document in your photos/videos or signs of tampering;
- Support Services to Client: Providing debugging, error analysis or support services to the Client in relation to your onboarding/authentication/verification;
Manner of collection
Your Facial Scan Data is provided by you to the Client for sharing it onwards with HyperVerge or collected by HypeVerge through the Client’s website or app. HyperVerge extracts Facial Facial Scan Information from your Facial Scan Data to Process Biometric Data for Permitted Business Purposes.Security Safeguards
Your data is safe with us. HyperVerge uses robust industry standards of care to store, transmit, and protect your Biometric Data from disclosure, in a manner that is at least the same as the manner in which HyperVerge stores, transmits, and protects other confidential and personal information.Data Retention
HyperVerge stores and uses the Biometric Data described above for Permitted Business Purpose for a maximum period of 180 (one hundred eighty) days, or such lesser period as is contractually agreed with the Client, after you or the Client submitted photos/videos of your face and/or identity document to HyperVerge. After such retention period, HyperVerge permanently destroys your Biometric Data that it stores, unless otherwise required by law or legal process to retain the data. During such period, HyperVerge stores all Personal Data and your Biometric Data in its dedicated cloud server with Amazon Web Services. You should read the Client’s own privacy related policies and terms of use to understand how long the Client may retain Biometric Data.Other Personal Data
In addition to the Biometric Data, HyperVerge will Process other personal data, including sensitive personal data, (for example IP address, Geolocation coordinates and other data about your device and personal data extracted from your identity document e.g. name, address, date of birth, document number, etc) (“Personal Data”) for the purposes listed above, which will be processed in accordance with HyperVerge Privacy Policy- Processor for Permitted Business Purpose.Limitations on Use
Other than for the purposes described in this Facial Scan Biometric Policy, HyperVerge will not sell, lease, trade, or, otherwise profit from Biometric Data. Disclosure of your Biometric Data: When Processing your Biometric Data on behalf of the Client, HyperVerge will only disclose, redisclose or otherwise disseminate Biometric Data in the following circumstances:- To the Client, to complete your authentication and verification for Permitted Business Purpose;
- As required by state or federal law, or municipal ordinance;
- As required pursuant to a warrant or subpoena issued by a court of competent jurisdiction;
- To a third-party Provider acting on HyperVerge’s behalf, namely Amazon Web Services, (which is HyperVerge’s cloud storage) (the “Vendor”) for storage purposes during the above-mentioned data retention period;
- By HyperVerge Inc. to HyperVerge Technologies Private Limited, which helps HyperVerge Inc. to provide services to the Client, including for providing engineering, technical, infrastructure, manpower or customer support; or
- As expressly consented to by you or your authorized representative.
Consent for using Biometric Data
On the Client website, application, platform, interface or otherwise, you will be asked whether you consent to the use of your Biometric Data as described in this policy. If you do not consent, HyperVerge will not extract Biometric Data from your photos/videos or audio recordings, Process your Biometric Data, or verify or authenticate your identity. BY CLICKING ON THE “ACCEPT” BUTTON, OR ANY OTHER SIMILAR MANNER OF CONVEYING YOUR ACCEPTANCE TO THIS FACIAL SCAN BIOMETRIC POLICY, YOU AGREE THAT YOU: (1) HAVE READ, UNDERSTAND, AND ACCEPT THIS HYPERVERGE FACIAL SCAN BIOMETRIC POLICY AND HYPERVERGE’S PRIVACY POLICY-PROCESSOR; (2) CONSENT TO HYPERVERGE, THE CLIENT AND VENDOR TO COLLECT, USE AND STORE YOUR BIOMETRIC DATA AND OTHER PERSONAL DATA FOR THE PURPOSES DESCRIBED IN THIS FACIAL SCAN BIOMETRIC POLICY; (3) GRANT PERMISSION TO HYPERVERGE TO DISCLOSE YOUR BIOMETRIC DATA TO HYPERVERGE TECHNOLOGIES PRIVATE LIMITED, THE CLIENT AND VENDOR IN ACCORDANCE WITH THIS FACIAL SCAN BIOMETRIC POLICY. Conflict: In the event of any inconsistency, the terms of this Facial Scan Biometric Policy shall prevail with other terms, policies or notices provided to you.
